The short answer: consent decides
People search for "ai girlfriend with my photo" or "create ai girlfriend from photo" meaning very different things. The rules treat them differently:
- A photo of a real person you know, an ex or a crush. Not allowed without their consent on any reputable app, and most ban it even with consent. Replika's terms go as far as naming ex-partners.

Why the rules are this strict
A realistic AI companion built on a real person's face can be turned into intimate images of someone who never agreed. That is the harm the rules target, and the law has caught up with it.
In the United States, the TAKE IT DOWN Act, signed on May 19, 2025, requires websites and social platforms to remove nonconsensual intimate images, including AI-generated ones, within 48 hours of a victim's request. Several apps in this list go further than the law requires and ban real people outright, whether or not you ever share the result.
The apps enforce this with filters and human review. Candy AI says content that breaks its rules is flagged, reviewed and removed, Secrets AI reviews uploads before they are posted, and breaking these rules is grounds for a ban on every app we checked. How to get the look you want without a real photo
You can get very close to a specific look with words and menus alone. This works on every builder in the picks:
- Pick the style first. Realistic or anime changes everything that follows. Selira AI and OurDream offer both.
- Describe features, not a person. "Shoulder-length auburn hair, freckles, green eyes, a warm smile" gives the generator what it needs without copying anyone.
- Use the menus for the basics. Hair, eyes, body type and outfit menus keep her consistent from picture to picture.
- Add a reference only if it is not a real person. An AI-generated portrait or a drawing works as a style guide on apps that accept one.
- Regenerate until it fits. Most builders let you reroll the portrait, sometimes for a small token cost.

Sharing your own picture is allowed on some apps, and it can make a chat feel more personal. Nomi's App Store listing says Nomis can see photos you send them, so you can show her your dinner or your view, and Joi lists "send her your photos" as a Premium Plus feature.
Putting your own face into generated scenes is rarer and more tightly controlled. Lovescape only allows face swap and uploads on its Creative Pro plan after ID verification, which protects other people from having their face used by someone pretending to be them.

A character that looks like a famous actress or streamer is the most common request that apps refuse.
